Abstract
This study aims to analyze how the Criminal Law Policy in the Ultimum Remedium principle in resolving ship accidents and how the role of the Shipping Court in conducting further investigations on ship accidents involves technical problems- various factors determine this are human error or other factors. This study uses a normative juridical research method, which is an approach method that departs from and focuses on all legal regulations that are theoretically considered relevant to the ultimum remedium principle in the criminal law policy system against ship accidents as shipping safety and security standards regulated in the Act international shipping and conventions. This study concludes that handling ship accidents at sea must refer to Law No. 17 of 2008 concerning Shipping and International Covenants. Several provisions regulate how ships can sail adequately and reduce the risk of ship accidents and the Shipping Court^s role in finding the cause of ship accidents at sea. In some incidents of ship accidents at sea, only the captain of the ship is in charge of the legal process so that there is a legal process, towards law enforcement process for ship accidents- there is often the neglect of ultimatum remediun in the criminal regime resulting in the law enforcement process of ship accidents, always ending in the criminal realm with the concept of punishing the perpetrators of the crime has been done or is called retributive justice

WATER POLLUTION CAUSED BY COLLISION AND ITS IMPACT ON THE MARINE ENVIRONMENT Irma Rachmawati Maruf

Abstract
The shipping industry conducts the majority of global trade- therefore, it must have a safe, cost-effective, and environmentally friendly mode of commercial transportation. Statistics indicate that maritime catastrophes have steadily decreased over the past decade, even though many incidents have drawn public attention to this issue. Even the International Maritime Organization has issued resolutions in the last decade to improve the safety of the shipping industry^s new regulations. Maritime incidents impact the marine environment in a variety of ways. Marine Pollution is caused by accidents and collisions, as well as human errors such as oil spillage, solid refuse, oil transfer, and bunkering. This study aims to investigate the marine pollution resulting from operational and collisions. The method is the analytical provision of the applicable marine environment law. According to the research findings, collisions between ships are becoming increasingly hazardous to the environment due to collision for all parties involved regarding human lives, the environment, and economic losses. In addition to shipping accidents, collisions, and oil leaks, and the discharge of ballast water into the sea cause Marine Pollution and environmental risks.

Abstract
The weakness of conventional management ports is the time-consuming procedures for completing documents. As a result, the dwelling time is even longer than the sailing time at sea. Furthermore, the physical documents required in the supply chain cost nearly half the travel price. Maritime activities involve numerous stakeholders, including customs port business entities, shippers, carriers, and insurance companies. The complicated procedures for document settlement lead to inefficient dwelling time. This paper aims to discover an appropriate port management model so the ports can export technology while supporting managerial and functional international trade. The methodology used is to analyze how the provisions of relevant laws impact the e-document and analyze it with a qualitative method. The supporting data are field (primary data), data collection techniques, in-depth interviews, and observations. With this research, the Port is expected to provide reliable and efficient support to transform technology and governance functionally using the appropriate legal framework. The ports will better compete with ports in neighboring countries using digitalization procedures.

THE LEGAL STATUS OF INFORMATION TECHNOLOGY APPLICATION-BASED TRANSPORT IN INDONESIA: LEGAL OR NOT? Siti Nurbaiti

Abstract
The existence of public transportation using digital information applications causing beneficial for users of transportation services and is important to facilitate the mobility of passengers or goods, but still raises problems regarding the legal status of its existence, whether it is legally valid or not as public transportation in the perspective of Indonesia regulations. The purpose of this study is to describe the legal status of the existence of transportation based on information technology applications in Indonesia. The method used in this study is descriptive normative research based on secondary data which is analyzed qualitatively by deductive conclusions. The results of the study illustrate that the legal status of the existence of information technology application-based transportation as stipulated in Law No. 22 of 2009 on Traffic and Road Transportation does not qualify such transportation as public transportation. This has been specified in Article 1 point (10) in conjunction with Article 1 point (21) in conjunction with Article 138 paragraph (3 ) in conjunction with Article 139 paragraph (4) of the Law no. 22 of 2009, juncto Article 36, Article 37, Article 38 of the Ministry of Transportation Regulation No. 108 of 2017. It can be concluded that the information technology application-based transportation does not fulfill the requirements for the validity of the agreement as stipulated in Article 1320 of the Indonesia Civil Code, and contrary to Article 1339 of the Indonesia Civil Code and also the Law No. 22 of 2009 on the Traffic and Road Transportation.

Abstract
The focus of the study in this article is the marriage system based on Balinese custom and the implications of the dissolution of marriage due to death on the rights of girls in Balinese customary law. The formulation of the problem in this study is what are the legal consequences of the dissolution of marriage due to death on the rights of girls in Balinese customary law. The type of research used in this research is empirical legal research. To analyze these legal issues, the authors use the theory of legal certainty by using a conceptual approach and a case approach. The results of the discussion in this study are in the case of dissolution of marriage due to death, it can be found that the rights of a daughter can be positioned as an heir in the case of having a sentana rajeg position, whereas if she follows the husband^s family law, the inheritance rights will be lost because she will carry out her obligations. in her husband^s house and inherit with her husband. The traditional Balinese marriage system adheres to a patrilineal system. Patrilineal is a community custom that regulates the line of descent from the father^s side. Meanwhile, a Balinese man will carry out his obligations to his ancestors so that he will get more inheritance rights.

Abstract
The village is a peripheral area that has considerable potential to be developed as a tourism village in improving the rural economy. This study aims to examine the role of Village Owned Enterprise (VOE) in managing tourism villages based on local wisdom from a business law perspective. This research uses non-doctrinal legal research methods with a socio-legal research approach. The research location is in the rural area of Bengkulu Province. The results of the study show that the management of tourism villages has not paid attention to the legal aspects of business, both from administrative legal aspects and civil law aspects. From an administrative law perspective, most VOE as managers of Tourism Villages are not yet legally incorporated. Likewise, the tourism business that is run does not yet have legality or permits. In the perspective of civil law, various collaborations related to tourism businesses are generally only carried out based on trust and verbal agreement. Thus the management of tourism villages based on local wisdom in the Bengkulu region by VOE does not yet have legal certainty. If a problem appears related to the tourism business, resolution carried out by deliberation between the parties.

Abstract
Ngerampag (merampas atau menyita) merupakan salah satu bentuk pamidanda (sanksi adat) yang dilakukan oleh Desa Adat terhadap orang atau kelompok yang berwenang menyita/mengambil alih kepemilikan suatu benda/barang krama desa (warga desa) yang tidak memenuhi kewajiban atau kesepakatan yang sebelumnya sudah disetujui bersama, terutama yang berwujud kewajiban tertentu sebagai krama banjar/desa adat. Adapun permasalahan yang dikaji disini adalah Bagaimana cara ngerampag yang sesuai dengan nilai kearifan lokal Bali?
Tujuan penelitian ini untuk menganalis sanksi adat pengerampagan yang diatur secara normatif di dalam suatu awig-awig. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan metode pendekatan awig-awig dan pendekatan konseptual. Sumber bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder, pengumpulan bahan hukumnya menggunakan teknik pencatatan. Setelah bahan hukum terkumpul selanjutnya dianalisis dengan teknik kualitatif dan disajikan secara deskriptif analitis.
Hasil penelitian menunjukkan bahwa di dalam setiap awig-awig Desa Adat di Bali mengatur perihal ngerampag (merampas atau menyita) harta krama desa (warga desa). Umumnya dalam awig tercantum beberapa hal berkaitan dengan ngerampag, antara lain: warga yang dapat dirampas hartanya, tata cara pelaksanaan ngerampag, petugas yang berwenang ngerampag, larangan-larangan ngerampag, serta konsekuensi bagi yang menghalang-halangi proses ngerampag.

mengatur tatanan kehidupan komunitas. Perkawinan merupakan momentum yang amat
penting dan disakralkan oleh masyarakat Hindu Bali. Dalam Perkawinan adat bali
adalah sebuah ikatan suci yang dilaksanakan antar dua individu atau orang yang ada di
dunia. Hukum adat Bali sifatnya memang tidak tertulis namun, dengan kesadaran
hukum yang dimiliki setiap anggota masyarakat menyebabkan tumbuh dan
berkembang hukum adat tersebut menjadi sejalan. perkawinan dalam kehidupan
masyarakat Bali juga tidak hanya dimaknai sebagai pertemuan dua insan manusia atas
dasar suka sama suka (cinta) semata, tetapi ada hal-hal mendasar harusnya dipatuhi
oleh pasangan tersebut. Bali menghindari bentuk patemuan (perjodohan/ perkawinan)
yang bertentangan dengan nilai-nilai sosial religius masyarakatnya. Perkawinan yang
dilarang atau dihindari oleh masyarakat Bali terutama perkawinan sedarah (inces tabo),
karena hal ini juga secara medis/ilmiah mempunyai efek/peluang besar untuk
menghasilkan keturunan yang tidak normal atau cacat fisik yang disebabkan oleh
adanya kesamaan genetik antara orang tua (ibu dan bapak).

Abstract
Marriage is commonplace between men and women on the basis of consensual and then mutual betrothed. Areca nut culture in Indonesia varies, generally applications are made by parties male families. however, it is different from the Sasak ethnic group kidnapping women at night without informing their parents (merariq). Based on the positive law it is not justified, but customary law allows it. This study analyzes the customary law ^merariq^ which is still being implemented by the Sasak ethnic community in Lombok, Indonesia. Sasak ethnic community as a unit of analysis in qualitative research with a case study approach. After processing the data obtained from the field findings through observation, in-depth interviews, and documentation, they were analyzed using Max Weber^s social action theory. The results of the study show that there are two models of the merariq tradition based on customary law, first traditional and affective actions that this tradition is carried out from generation to generation and based on the emotional ties of the Sasak ethnic community which are still strong in implementing customary law. Second, instrumental rationality and values for the Sasak ethnic community carrying out the merariq tradition practically in accordance with customary law by following the times based on values and norms in ^merariq^ customary law. The social actions of the Sasak ethnic community in carrying out the Merariq tradition are spontaneous, hereditary, and keep up with the times and do not depart from the values and norms of Merariq customary law.

Abstract
Desa Adat yang memiliki otonomi asli telah berkembang sepanjang sejarah selama berabad-abad. sekarang ini Desa Adat telah memberikan kontribusi yang sangat berharga terhadap kelangsungan kehidupan masyarakat Bali, dan berperan positif dalam segala aspek pembangunan di Desa, terutama di dalam bidang agama dan sosial budaya. Kesatuan masyarakat hukum adat beserta hak tradisionalnya yang masih hidup harus memiliki wilayah dan paling kurang memenuhi salah satu atau gabungan unsur adanya masyarakat yang warganya memiliki perasaan bersama dalam kelompok, pranata pemerintahan adat, harta kekayaan dan/atau benda adat, dan perangkat norma hukum adat. Pacalang merupakan kerja pengabdian dan tidak digaji, dipilih oleh warga, menjaga kesakralan ritual agama, dan sebagainya sehingga mereka lebih disegani. Permasalahan yang diangkat adalah Bagaimana peran pacalang dalam menjaga keamanan desa adat di Bali dan Bagaimanakah hambatan pacalang dalam menjaga keamanan desa adat di Bali yang berorientasi pada konsep Tri Hita Karana. Metode penelitian yangdigunakan adalah penelitian hukum normatif. Hasil penelitian ini dapat digunakan sebagai dasar hukum untuk mengetahui dan memahami lebih mendalam tentang pacalang dalam menjaga keamanan di desa adat.

Abstract
Masalah kekerasan dalam rumah tangga merupakan salah satu bentuk kejahatan yang melecehkan dan menodai harkat kemanusiaan, serta patut dikategorikan sebagai jenis kejahatan melawan hukum kemanusiaan. Kekerasan dalam rumah tangga merupakan suatu permasalahan dalam keluarga. Kekerasan Dalam Rumah Tangga (KDRT) bisa menimpa siapa saja termasuk, suami, istri, anak-anak mereka dan orang-orang yang tinggal bersama dalam rumah tangga yang menjadi tanggungan secara ekonomi. Dari uraian di atas, maka penulis melakukan penelitian untuk mengetahui dan menjelaskan lebih dalam mengenai : pengaturan dan penerapan pemidanaan terhadap pelaku tindak pidana kekerasan dalam rumah tangga (studi kasus pengadilan distrik dili). Suatu penelitian harus mempunyai tujuan yang jelas sehingga dapat memberikan arah dalam pelaksanaan penelitian tersebut. Tujuan diadakanya penelitian ini adalah : 1. Untuk mengetahui dan menjelaskan pengaturan tindak kekerasan dalam rumah tangga. 2. Untuk mengetahui dan menjelaskan proses penerapam pemidanaan terhadap KDRT.

Abstract
Ownership of Land Rights for Foreign Nationals in terms of Law No. 5 of 1960 concerning Basic Regulations of Agrarian Principles and Law No. 12 of 2006 concerning Citizenship. Dual citizenship means that someone in addition to having Indonesian citizenship, also has citizenship of another country (foreign). With the existence of mixed marriages in Indonesia, it affects the ownership of community property in marriage. Joint property in marriage can also take the form of ownership of certain objects. One of them is Hak Milik which is the most powerful and inherent right that can be owned over land in Indonesia. However, many cases arise regarding the ownership status of land rights obtained by foreigners through the mixing of marital assets in marriages between Indonesian citizens. Therefore, this research journal is intended to further examine the ownership status of land rights in Indonesia owned by foreigners through mixed marriages

Legal Status of Customary Land Rights in Indonesia^s Mining Investment Policy Ismail Rumadan, Ummu Salamah

Abstract
Every investment policy in the mining sector in Indonesia always conflicts between community members and mining companies. These conflicts are generally related to the control of land or community land designated for mining areas, especially the land of indigenous peoples in areas where mining investment is carried out. Some examples of cases include conflicts between indigenous peoples and mining companies in Podi Village, Tojo Una-una Regency, Central Sulawesi- conflicts in Central Weda District, conflicts in Central Halmahera-North Maluku, and conflicts in Murung Raya, Central Kalimantan. These conflicts occurred due to the control of customary land by mining companies without regard to the rights of local indigenous peoples to customary land rights that have been owned for generations which were then forcibly used for the benefit of mining investment.
Noting the various conflicts that arise in every use of indigenous peoples^ land for investment purposes above shows that the position and position of indigenous peoples is very weak, especially in relation to the legal status of customary land rights. Therefore, this study aims to examine the legal status of customary land rights, which are constructed as part of an unwritten legal regime that has a constitutionally strengthened basis in the national legal system. And the interests of mining investment projected as a public interest based on written law.
The method used in this study is a juridical-sociological approach, by examining normative sociological legal status of customary land in the national legal system, and mining investment legal policies in a normative legal perspective for the public interest.
The assumption of this study shows that the legal status of customary land rights has experienced a decline in legitimacy, along with the development and change in the structure of community life from traditional society to modern society oriented towards a positive-legalistic view. This condition weakens the position of indigenous peoples in defending customary land rights that are intended for the benefit of mining investment.

A STATE OF BREAKING THE LAW CAUSED BY ABRATION A RESEARCH IN JEMBRANA REGENCY Yohanes I Wayan Suryadi

Abstract
A state of breaking the law has been regulated in article 1365 of the Civil Code, but this is purely the result of human actions. What if a person or society unknowingly, is in a state of breaking the law caused by the effects of global warming, in this case abrasion by sea water. This study aims to discuss and find solutions, so that people living on the coast who previously met the requirements regulated by laws and regulations, are still protected and get legal certainty, so that the law benefits the community. In Law Number 27 of 2007 concerning Management of Coastal Areas and Small Islands, Article 1 paragraph 21 junto Article 12 Paragraph 4 of Law Number 51 of 2016 concerning Coastal Borders, the minimum distance between the coastal border and the highest point of the tide is 100 meters. To have a building that meets government standards in accordance with applicable laws and regulations, the community and tourism business people, especially investors who have built 20 years ago or more, who own property on the beach must have met the requirements so that they have sufficient permits. However, global warming which has an impact on increasing the volume of sea water so that in addition to having an impact on abrasion on many coasts, this unknowingly also has an impact on coastal boundaries which in the legislation the minimum distance is 100 meters, but when measured at this time, most of the buildings are more than 20 years old, their position violates the coastal border regulations. This situation places coastal communities and tourism supporting buildings in a state of breaking the law caused by abrasion as a continuation of the effects of global warming.

Abstract
One form of local wisdom in Bali that can be used as a foothold in resolving disputes in the tourism sector in Bali is Tri Hita Karana. The concept of Tri Hita Karana is a concept based on the principle of harmony or harmony of life. The purpose of this study is to know and analyze the urgency of the Tri Hita Karana concept as a form of Local Wisdom in efforts to resolve disputes in the tourism sector towards the development of sustainable tourism development in Bali. This research uses normative legal methods through an analytical and conceptual approach, where all problems are studied based on concepts, theories, principles, and applicable laws and regulations, namely the provisions of Law Number 10 of 2009 concerning Tourism. The results showed that the concept of Tri Hita Karana as a local wisdom in the development of tourism in Bali became a philosophy of balance of people^s lives, by applying this concept to dispute resolution in the tourism sector in Bali should be minimized, because this concept prioritizes the restoration of a dispute based on the family system, then undoubtedly the development of tourism in Bali will have a good impact on local people.

Abstract
Bayung Gede Village is an old village that has a unique culture, namely the tradition of hanging the placenta. Commonly, Balinese people will plant the placenta in front of the bale daja or it will be washed away into the sea yet, in the village of Bayung Gede, the placenta will be hung at the setra (cemetery) of the placenta. This tradition has been packaged as a cultural tourism attraction. The community as the main component in this tourism plays an important role in maintaining local wisdom. The purpose of this study was to identify forms of community participation in the tradition of hanging the placenta in the form of cultural tourism attractions
This study used a qualitative descriptive research method with data collection techniques through observation, interviews, and document studies. Informants in this study were selected by purposive sampling. This study used the theory of participation. The results of the research revealed that the forms of community participation were in planning, implementing, and supervising.
The results of the research suggest that the community should be able to maintain the tradition as well as the preservation of local wisdom. Next, the government should be able to protect its people through improving the quality of human resources and building infrastructure. Lastly, the tourists should be able to make Bayung Gede village as an option for traveling.

Abstract
The principle of democracy from the people by the people for the people is a phrase that is manifested in the social interaction of Village Head Elections. The Village Head is a position that can be contested by Indonesian citizens who are elected in the Village Head Election as legitimacy for a six-year term of office. Elections for Village Heads often have the potential for money politics which is interpreted as an effort to influence voters (voters). In general, money politics in village head elections is given in the form of money for transportation from place of residence to polling stations, provision of groceries, assistance for worship facilities and even construction of roads, this has become a social phenomenon in society which later became the theme of this research. This research was carried out using a normative juridical approach, while the problem identification was 1) what are the forms, methods and potential impacts of money politics in village head elections? 2) What efforts can be made by policy makers in tackling the problem of money politics? In its implementation, often money politics in the Pilkades implementation cannot be resolved in accordance with the applicable legal regulations with various existing problems.

Abstract
A grant is interpreted as a gift for free and cannot be canceled unless the recipient of the grant fulfills certain conditions. This research aims to analyze the Blora District Court Decision No. 38/Pdt.G/2021/PN Bla which cancels grants given by parents to their adopted children. The method used in this research is normative juridical in a case study of the Blora District Court Decision Number 38/Pdt.G/2021/PN Bla. The judge decided to annul the Deed of Grant Number 228/TJN/2012 based on Article 1688 letter c of the Civil Code and ordered the Blora District Land Office to record the transfer of rights to Certificate Number 532 from on behalf of the grantee to on behalf of the grantor because of Grantee refuses to provide a living for the Grantor.

Abstract
Penelitian ini bertujuan untuk mengtahui sanksi terhadap masyarakat yang tidak melakukan pengelolaan sampah rumah tangga seiring bertambahnya jumlah penduduk, perubahan pola konsumsi masyarakat, dan gaya hidup masyarakat di Kota Denpasar. Tentunya dapat meningkatkan jumlah timbunan sampah, jenis sampah, dan keragaman karakteristik sampah lainnya.Pengelolaan sampah di Kota Denpasar diperlukan adanya peran serta masyarakat dalam pengelolaan sampah rumah tangga baik pemilahan dan pengumpulan sampah organik maupun sampah an-organik. Terkait peran masyarakat disini diperlukan juga sanksi terhadap masyarakat yang tidak melakukan pengelolaan sampah karena pemerintah tidak bisa hanya berharap terhadap kesadaran masyarakat dan perlu mengikat masyarakat dengan sanksi agar masyarakat ikut berpartisipasi dalam pengelolaan sampah rumah tangga. Oleh karena itu judul penelitian ini adalah sanksi terhadap masyarakat yang tidak melakukan pengelolaan sampah rumah tangga dengan menggunakan metode penelitian hukum Normatif, karena penelitian ini menyangkut pendekatan undang - undang dilakukan dengan menelaah undang-undang atau peraturan hukum lainnya sesuai dengan isu yang bersangkutan.

Abstract
Mining has become an important sector in the country^s economy and contributes to economic growth and regional development. In West Kalimantan, mining companies are scattered in various districts such as Mempawah Regency, Landak Regency, Sanggau Regency, Kubu Raya Regency, Kayong Utara Regency, Ketapang Regency, and other regencies. Based on the large number of mining companies that are scattered over time, it can cause various problems. One of the most significant problems at this time is unsustainable mining management, which causes negative impacts on the environment, society, and socio-economic sustainability. This study utilizes a normative legal research approach that specializes in the analysis of laws and regulations, policies, and related legal documents relevant to mining development in West Kalimantan. A progressive legal approach is used to obtain a more holistic and justice-oriented perspective in developing sustainable mining by incorporating relevant local wisdom in West Kalimantan. Meanwhile, the conclusion of this research is to promote and ensure the relevance of various regulations, especially those related to mining, with an approach that involves all relevant parties in the planning, implementation, and supervision of mining activities. This way, balanced economic, social, and environmental sustainability can be achieved.

Abstract
Promotion and protection of the rights of people belonging to national or ethnic religious and linguistic minorities contribute to the political and social stability of the countries in which they live must continue to respect the rights of persons belonging to national or ethnic minorities religion and language as an integral part of the development of society as a whole and in a democratic structure based on the rule that law is supreme and will contribute to the strengthening of friendship and cooperation between nations and countries. Promotion and protection of the rights of people belonging to national or ethnic religious and linguistic minorities contribute to the political and social stability of the countries in which they live must continue to respect the rights of persons belonging to national or ethnic minorities religion and language as an integral part of the development of society as a whole and in a democratic structure based on the rule that law is supreme and will contribute to the strengthening of friendship and cooperation between nations and countries. The UN narrative on indigenous peoples^ rights or the United Nations Declaration on Indigenous People read in 2007 is the only international human rights law instrument that specifically and explicitly regulates the protection of traditional knowledge. It has received broad support from both developing and developed countries.

Abstract
The issuance of Job Creation Law in 2020 raised so many controversies both the process and the content of the Law. Substantively, of the law consists of multiple topics which are not related each other. In addition, the lawmaking process contains serious problems such as lack of public participation. The Court ruled that Job Creation Law conditionally unconstitutional. The Court requires the lawmakers to fix the law-making process by involving public meaningfully. It means during the lawmaking process the legislator should satisfy 3 important elements. They are: the right of the public to be heard, to be considered, and to be explained. The lawmaker was not really happy with the Court decision because the Job Creation law is very important as the foundation for the government to invite more investors in Indonesia. This result in the parliament retaliates the Court by recalling one of the constitutional justices. Since then the relation between the Court and the Lawmaker change significantly. The paper will analyze how significant is the court ruling on Job Creation law change the relation between the judiciary and the legislator? The paper tentatively argues that post court ruling on Job Creation Law, there is a tendency that the lawmakers play more dominant roles compared to the Court. This can be seen on how the legislature determine the substitute Constitutional Court Justice and the reluctant of the legislature to properly follow up the Court ruling.

Abstract
Bali is one of the main tourist destinations for domestic and foreign tourists. The diversity of art and culture is the main attraction. Therefore, the tourism sector in Bali is relied upon by the Bali Provincial Government and the Balinese people as a source of the Balinese economy. One of the tourist destinations and cultural heritage of Bali is Subak. Subak is a Balinese local wisdom organization that deals with the irrigation system of agricultural waters in a traditional way. Subak is more than just a rice field irrigation management organization. it is also an identity of Balinese society that has been recognized as a world cultural heritage by UNESCO. Currently, the existence of Subak is on the verge of extinction. The extinction in this regard refers to the diminishing of agricultural land due to land conversion. Subak is currently facing the issue of land conversion which is increasing over time. o overcome this, innovations are needed that support agriculture as a tourism partner, with the aim of reducing land conversion. One of the proposed solutions is through the development of ecotourism, which is a form of tourism that is responsible for the sustainability of nature and makes a positive contribution to the welfare of local communities. The existence of ecotourism is expected to reduce the conversion of rice fields that occur.

Abstract
The state has the authority to supervise the use of land so that it is exploited and used to
realize prosperity not only for the holders of the rights but also for the welfare of the
community, nation and state. The state has the authority to designate an area and land into an
area and abandoned land. Based on this background, it is interesting to study: 1. What is the
nature of the regulation of abandoned areas and lands? and 2. Why is the involvement of
traditional villages in Bali important in utilizing abandoned areas and lands for sustainable
tourism development? The research method used is normative legal research, using statutory
and conceptual approaches. The essence of regulating abandoned areas and lands is to
reorganize and realize land as a source of people^s welfare, improve the quality of the
environment, reduce poverty and create jobs. The involvement of traditional villages in Bali is
important in the utilization of areas and lands that are indicated to be neglected in regulating
in an ^awig-awig^ regarding the physical use of land by ^krama desa^ who live around the
land for tourism activities, which is in line with the concept of tourism sustainable.

Abstract
This study examines environmental licensing that prioritizes a risk-based approach in investing which will be associated with the special laws and regulations of The Job Creation Law. The Job Creation Law has an economic approach to create jobs and improve the investment climate in a country. But on the other hand, related to the environment emphasizes more on conservation aspects. This is then a problem in the application of environmental permits. What are the potential and constraints that arise in implementing risk-based licensing in realizing sustainable development? The study used normative legal research using primary legal materials and secondary legal materials. As well as the engineering used, among others, statutory, conceptual, philosophical approaches. As for in this study found that there is a philosophical conflict between the Job Creation law and the Environmental Management Law. It can be seen from the aspect of orientation where the Job Creation Law is more investment-oriented, while on the other hand, the Environmental Management Law prioritizes conservation or maintenance. On the other hand, there is a tendency in the job creation law from the aspect of management to centribalization, while on the other hand, in the Environmental Protection and Management Law there are some that are the authority of the Regional Government.
