Question from Mr. Suryanto Siyo

Children work because they are driven by the family^s economic needs. We can see
cases of children transporting palm fruit in plantations. How does the government
reach out to palm oil plantations to provide legal protection?

based on law Article 68 number 13 of 2003 concerning employment
^entrepreneurs are prohibited from employing children^, however in this article
there are exceptions where entrepreneurs can employ children in light work as
long as it does not interfere with physical, mental and social development and
health as regulated in Article 69 of the law. Law number 13 of 2003. So it can be
concluded that children can work as long as the work is as regulated in the law.
However, it needs to be underlined that the worst jobs are prohibited from being
carried out by children according to Article 74 of Law Number 13 of 2003. In
terms of children working on oil palm plantations, this is dangerous work.
because children who work in the plantation sector often do not receive
protection, employers employing children is not in accordance with article 69 of
law number 13 of 2003. the government issued DECREE OF THE MINISTER OF
NATIONAL DEVELOPMENT PLANNING/ HEAD OF THE NATIONAL DEVELOPMENT
PLANNING AGENCY NUMBER KEP.96/M .PPN/HK/07/2021 CONCERNING THE
FORMATION OF A PARTNERSHIP TEAM FOR ACTION TO OVERCOME CHILD LABOR
IN THE AGRICULTURAL SECTOR (PARTNERSHIP FOR ACTION AGAINST CHILD
LABOR IN AGRICULTURE - PAACLA INDONESIA). With this regulation supporting
the acceleration of overcoming child labor in the agricultural sector, it is necessary
to develop a Partnership for Action to Overcome Child Labor in the Agricultural
and Plantation Sectors. because children working on plantations or agriculture is
the worst job for children.
