Legal Protection of Customers Using E-Banking Services in Facing Malware Threats

Abstract

Technological developments spur human evolution towards a more advanced future. Banks follow the times by creating e-banking services. The convenience provided by banks also raises the threat of malware crime. This research aims to analyze the form of legal protection applied by banking institutions and the Indonesian Consumers Foundation and the obstacles faced by banking institutions in protecting customers who use e-banking services from the threat of malware. The research method used is a qualitative method with a normative legal approach. This research uses two data, namely secondary data and primary data. Secondary data is collecting data and information about facts related to research problems and research objectives formulated and filtered from journals, literature studies, and publication reports of an institution, and confirmed and verified using primary data, namely conducting an interview with one of the bank employees related to e-banking. The analysis used in this research is confirmation and verification of the results of secondary data and primary data, through interviews with one of the bank parties related to e-banking this research problem. The results show that the way banks protect their customers is by implementing OJK Regulation Number 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector, and ITE Law Number 11 of 2008 concerning Electronic Information and Transactions, and Bank Indonesia Regulation Number 10/10/PBI/2008 concerning Amendments to Bank Indonesia Regulation Number 7/7/PBI/2005 concerning Customer Complaint Settlement, and Law Number 8 of 1999 concerning Consumer Protection, OJK Regulation Number 6/POJK.07/2022 concerning Consumer Protection. Protection carried out by banks to protect their digital banking systems, namely banks using Secure Socket Layer (SSL) encryption technology in Mobile Banking applications and Multi-Factor Authentication (MFA) in e-banking services.
